Access to the Website and use of its contents implies unreserved acceptance by the user of these General Conditions of Use. ECUPHAR is the owner of the Internet domain containing this Website. The contents and services that ECUPHAR makes available to the user on the Web Site may also be regulated by specific conditions which, in the event of conflict, shall prevail over the General Conditions of Use (the "Specific Conditions"). The user is also subject, each time he/she uses the corresponding content or service, to the corresponding applicable Special Conditions. The Website contains information on the products and services offered by ECUPHAR or any of the companies belonging to the group to which ECUPHAR belongs. Some of these products and services may not be available in some countries. Reference to any ECUPHAR product or service on an ECUPHAR website does not mean that such product or service is available in your location. The information contained in this Web Site should be considered general information and may not be used or construed as veterinary or any other type of advice. Decisions regarding the health of animals should be made by healthcare professionals, taking into account the individual characteristics of the animal. Such issues will not be addressed or answered through the Website. In such cases, you should contact medical specialists and health professionals. Likewise, some of the information or services contained on the Website may be intended exclusively for persons authorised to prescribe or dispense medicines, and therefore, if you do not belong to this group, you will be asked, at the time of access, to refrain from continuing. It is ECUPHAR's intention to provide accurate and up-to-date information at all times. However, this information may contain technical inaccuracies or typographical errors. ECUPHAR accepts no responsibility for the suitability of the information contained on the Website. In no event shall ECUPHAR be liable for any damages for loss of use, data or profits, as a consequence of viewing, using the software, documents, information or services, in general, available on this Website. ECUPHAR adopts reasonably adequate security measures to detect the existence of viruses. However, the user must be aware that the security measures of computer systems on the Internet are not entirely reliable and that, therefore, ECUPHAR cannot guarantee the non-existence of viruses or other elements that may cause alterations in the user's computer systems (software and hardware) or in their electronic documents and files contained therein. Each country may have its own legal requirements or medical practices. The information contained in each of the websites is intended to be used, where appropriate, exclusively by health professionals in the country to which the website corresponds. ECUPHAR may offer services through the Website that may be subject to their own Particular Conditions about which you will be informed in each specific case. CORRECT USE OF THE WEBSITE
The user undertakes to use the Website, its contents and services in accordance with the Law, these General Conditions of Use, the Specific Conditions, good customs and public order. Likewise, the user undertakes not to use the Website, its contents or the services provided through said Website for purposes or effects that are illicit or contrary to the content of these General Conditions of Use (and, where applicable, the Specific Conditions), harmful to the interests or rights of third parties, or which in any way may damage, render unusable, make inaccessible or deteriorate the Website, its contents or its services or prevent normal enjoyment of the same by other users. Likewise, the user expressly undertakes not to destroy, alter, render useless or in any other way damage the data, programmes or electronic documents contained on the Website and not to hinder the access of other users by means of the massive consumption of the computer resources through which ECUPHAR provides the service, or to carry out actions that damage, interrupt or generate errors in said systems or services. Similarly, the user undertakes not to introduce programmes, viruses, macros, applets, "ActiveX" controls or any other logical device or sequence of characters that cause or are likely to cause any type of alteration in the computer systems of ECUPHAR or third parties. The documents and graphics published on this Website may include technical inaccuracies and typographical errors. Changes are periodically added to the information made available. ECUPHAR and/or its respective supplier may make improvements and/or changes in the product(s) and/or the program(s) at any time. Likewise, ECUPHAR may at any time modify these General Conditions of Use without prior notice and we therefore recommend that you periodically review these General Conditions of Use.
CONTENT, SERVICES OUTSIDE THE WEBSITE AND ADVERTISING
These General Conditions of Use refer only to the ECUPHAR Website and do not apply to third-party websites. However, the Website makes available to the user, solely for the purpose of searching for and accessing content and services available on the Internet, hyperlinks or technical linking devices, which allow the user to access websites or Internet portals belonging to or managed by third parties (the "Third Party Websites"). The Third Party Websites referred to above are not under the control of ECUPHAR and, consequently, ECUPHAR (or any companies belonging to the group to which ECUPHAR belongs) is not responsible for the content and services of any of the Third Party Websites. These Third Party Websites are provided solely to inform you of the existence of other sources of information on a particular subject and the inclusion of a link on this Website does not imply ECUPHAR's endorsement of the Third Party Websites. On the other hand, any natural or legal person who intends to establish a hyperlink or technical linking device from a Third Party Website to this Website must obtain prior written authorisation from ECUPHAR. In any case, the establishment of a link from a Third Party Website to this Website does not imply, under any circumstances, the existence of a relationship between the owner of the Third Party Website and ECUPHAR, nor the acceptance or approval by ECUPHAR of its contents or services. The Website may also host advertising content or be sponsored. Advertisers and sponsors are solely responsible for ensuring that the material submitted for inclusion on the Website complies with the laws that may be applicable in each case. ECUPHAR shall not be liable for any error, inaccuracy or irregularity that may be included in advertising or sponsor content.
INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS
This Website contains or refers to intellectual and industrial property rights, including, but not limited to, source code, design, structure and navigation architecture, databases, photographs, phonographies, distinctive signs, patents, utility models, information, technologies, products, processes or other intellectual or industrial property rights, which are owned by ECUPHAR (or, where applicable, by third parties who have authorised and/or licensed their use in favour of ECUPHAR) or by third parties. By virtue of these General Conditions of Use, no intellectual or industrial property rights are transferred over the Website or any of its constituent elements, and the user is expressly prohibited from reproducing, transforming, distributing, publicly communicating, making available, extracting, reusing, resending or using any of them in any way, by any means or procedure, except in cases where this is legally permitted or authorised by the owner of the corresponding rights. Questions and suggestions
Any questions, comments or suggestions regarding the content of the documents on this Web Site shall be deemed to be non-confidential and ECUPHAR shall have no obligation of any kind with respect to such information and shall be free to reproduce, use, disclose or distribute it without limitation. ECUPHAR shall be free to use any ideas, concepts, know-how or techniques contained in such communications for any purpose whatsoever, including but not limited to developing, producing and marketing products.
COMMUNICATIONS AND PARTICIPATION IN FORUMS, BLOGS AND SOCIAL NETWORKS
ECUPHAR may offer users the possibility of entering various contents (such as comments, photographs or others), to be included in the corresponding sections. The publication of contents is subject to these General Conditions of Use. The user identified in each case as the one who has submitted the contents is responsible for them. The contents do not reflect the opinion of ECUPHAR, nor does ECUPHAR make any statements in this regard. ECUPHAR shall not be held liable for any errors, inaccuracies or irregularities that the contents may contain, nor for any damages that may be caused by the insertion of the contents in the sections of the Website that, where applicable, allow this type of service. The user supplying the contents assigns to ECUPHAR the rights to exploit the same (including reproduction, use, distribution, public communication and any type of activity thereon), both in electronic, digital and paper format, as well as in any other type of support, in all languages and for the entire world territory. In particular, the user assigns these rights to be placed on the Website, so that other users of the Website can access them. The supplying user declares that he/she is the owner of the rights to the contents and also guarantees that he/she has the necessary rights and authorisations from the author or owner for their use by ECUPHAR through the Website. The supplying user undertakes to assume any possible claim directed against ECUPHAR in relation to the contents supplied and, in particular, and without limitation, for infringement of the rights to honour, privacy and self-image and/or for intellectual and industrial property rights that third parties may hold over the rights to the contents, holding ECUPHAR harmless from any costs, expenses and indemnities that may arise for such reasons. Without prejudice to the foregoing, ECUPHAR shall not be held liable for any damages that may be caused by the use, reproduction, distribution or public communication or any type of activity carried out on the contents that are protected by intellectual and industrial property rights belonging to third parties, without the user having previously obtained the necessary authorisation from the owners to carry out the use that he/she is making or intends to make. Likewise, ECUPHAR reserves the right to unilaterally remove the contents hosted in any other section of the Website when ECUPHAR deems it appropriate. ECUPHAR shall not be liable for the information sent by the user when it does not have effective knowledge that the information stored is unlawful or that it harms the property or rights of a third party liable for compensation. As soon as ECUPHAR has actual knowledge that it is hosting data such as the aforementioned, it undertakes to act diligently to remove them or make access to them impossible. The user may join, if such a possibility exists, the groups that ECUPHAR has in different social networks. To this end, the user must accept the conditions of use and privacy policy of the corresponding social network.
APPLICABLE LAW AND JURISDICTION
This Website is governed by Spanish law. ECUPHAR and the user, expressly waiving their own jurisdiction, submit to the jurisdiction of the Courts and Tribunals of the city of Barcelona (Spain), except in those cases in which, by legal imperative of private international law, the Courts and Tribunals of the user's domicile are competent.
